Whether a bankruptcy court may authorize the distribution  of  settlement  proceeds  in  a  manner  that  violates the statutory priority scheme. 11 U.S.C. § 507(a)(4), (5).

DECISION

Decided March 22, 2017 HOLDING

Petitioners have Article III standing. Bankruptcy courts may not approve structured dismissals that provide for distributions that do not follow ordinary priority rules without the consent of affected creditors.
